
BDG Law Group has obtained a complete defense victory on behalf of the County of Los Angeles and the Los Angeles County Flood Control District, successfully closing a multi-year case stemming from a catastrophic 2017 storm event in Acton, California.
The plaintiffs alleged that inadequate culverts and drainage systems caused damage to property stored in a low-lying, open-air storage facility during a 500-year rainstorm. Plaintiffs sought over $2,000,000 in damages based on claims of inverse condemnation, breach of mandatory duty, and dangerous condition of public property.
After a full trial in Lancaster from June 23 to July 9, 2025, the BDG trial team – Greg Bergman, Richard Fond, and Lisa DeLorme – won a complete defense victory on all counts. On the claim for inverse condemnation, the court granted both defendants’ motion for judgment following the completion of the evidence. On the claims for breach of mandatory duty and dangerous condition of public property, the jury returned a unanimous verdict in favor of both defendants.
